This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by IM Creative, Inc. (“we,” “us,” “our,” or “IMC”).

This Privacy Policy governs your use of IMC’s website at https://imcexperiences.com/ and at https://imc.studio and any related subdomains thereof (the “Site”), and our mobile application (“App”). For the purposes of this Privacy Policy, we will refer to the Site, App, and the provision of Offerings to customers collectively as the Services (the “Services”).

Personal Information means any identifying information, usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

We may update this Privacy Policy from time to time and will mark new versions with a corresponding effective date. We recommend you visit the Site to review any changes in our practices. Your continued use of the Services constitutes your agreement to our then-current Privacy Policy.

Scope

This Privacy Policy applies to Personal Information that IMC collects and processes for its own business purposes and its direct interactions with customers, prospective customers, vendors, and business contacts.

In connection with providing our event planning, campaigns, tradeshows, exhibits, summits and conferences, pop-ups, and other creative services offerings (“Offerings”) to customers, we may receive from and process Personal Information on behalf of our customers. When IMC collects such Personal Information as a service provider or processor to its customers, this Privacy Policy does not apply to the processing of such Personal Information. Our customer agreements along with the customer’s own privacy policy, rather than this one, will apply to the Personal Information processed, and we direct individuals to review that policy if they have any questions about how their data is obtained or processed in connection with the Offerings or wish to exercise their rights (if any) with respect to that Personal Information.

What Information is Collected?

Information Collected Directly from You

IMC provides its Services exclusively to businesses, organizations, and other commercial entities rather than to individual consumers. Our Offerings are designed for business-to-business use, and we do not market, sell, or otherwise direct our Services to individuals acting in a personal or household capacity. We may collect Personal Information about you in this business-to-business context when you sign up for a mailing list, request an initial consultation, or more information about our Services by calling or emailing us, or as part of other online services.

The information we may collect includes, but may not be limited to:

  • Personal Information categories such as your name, your company name, role and business affiliations, telephone number, mailing address or email address

  • Identifiers, such as a real name, unique personal identifier from our business customers, online identifiers, IP address, and email address

  • Commercial information, such as records of Offerings purchased, obtained, or considered, or other purchasing or consuming histories or tendencies of our business customers

  • Visual information, such as photos from the events we host

  • Payment data, such as billing information of our business customers

  • Internet or other similar network activity, such as IP address, browsing history or information on a user’s interaction with our Site

  • Geolocation information

  • Professional information, such as employment history when you apply for an open position

  • Inferences drawn from other personal information, such as profile information reflecting a person’s preferences

  • Other information related to your requests or inquiries or information you input into the “Message” box to contact us regarding our Services

Information Collected Automatically

To provide you with Services, complete your requests, and maintain functional Services, we may automatically collect certain information when you visit or navigate the Services, including:

  • Location, date, and time you access the Services, and IP addresses to measure our Site traffic and to help provide a more personalized experience;

  • Your browser type and other technical specifications such as device ID, hardware/software type, internet service provider, serving domains, mobile device identifiers;

  • Your search and transaction history relating to the use of our Services;

  • Files that allow us to “recognize” you when you navigate the Site, and collect data such as analytics, page views, and interaction data; and

Information Collected From Third Parties

We may obtain Personal Information about you from third party sources, including data brokers, marketing partners, public databases or other publicly available sources.

Collecting Information from Children Under the Age of 16

Our Services are not designed or targeted for children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on our Services without their permission. If you learn that a child under the age of 16 has provided us with Personal Information in violation of this Privacy Policy, then you may alert us at it@imcexperiences.com. We will take reasonable steps to delete that information as quickly as possible.

How Is the Information We Collect Used?

We collect information about you in order to provide you with Services, and to make the Services work properly. We use Personal Information for a variety of purposes related to our business, including, but not limited to:

Providing services and support

Performing the essential functions of the Services including responding to inquiries, fulfilling orders and requests, processing estimate requests, processing payments, providing support and troubleshooting, data aggregation, analysis and report creation to assess marketing effectiveness and/or business performance, and communicating with users about their use of the Services or responding to a user-initiated inquiry on the Services.

Communicating with users about Services

Sending or initiating direct marketing programs, such as newsletters or information about new Services we are offering; using content from social media platforms where users discuss our Services or use a hashtag related to our Services.

Personalizing user experiences on our Services

Tailoring content on the Services based on a user’s location, preferences, and other personalization factors.

Analytics and Services improvement

Tracking information about your visits to our Site or use of the Services to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the Services and develop additional Services to offer.

Compliance with legal obligations

Sharing information as required or appropriate to comply with the law or a legal proceeding, such as in response to a subpoena or court order, to detect and investigate security incidents and potentially illegal or prohibited activities or to protect your, our, or others’ rights, property, or safety.

Service Providers

We may share non-individual information, in the aggregate, regarding your online browsing preferences to evaluate our Services or allow the service providers with whom we work with to better serve our users. We will not share personally identifiable information in these instances, other than as described in this Privacy Policy.

We may provide user information to our service providers or vendors for reasons such as:

  • Maintenance of Services

  • Development of online Services, or customer service, or new offerings, or

Legal and Compliance

We may also share your Personal Information in connection with government or law enforcement requests or in response to investigations, subpoenas, court orders, or other legal processes to: operate the Services, process any orders or registrations, protect the rights or property of IMC, its affiliates, users, and customers, establish or exercise our legal rights or defend against legal claims, or as otherwise required by law.

Business Transfers

We may also disclose your information to a third party as part of a reorganization or a sale of the assets of IMC, or its subsidiaries or divisions. Any third party to which IMC transfers or sells the Services or related assets will have the right to continue to use the Personal Information and other information that you provide to us. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.

Cookies, Pixels, and Similar Technologies

We use cookies, pixels, and similar technologies to gather information about your use of our Services and to customize your experience using the Services.

Pixels

Pixels are small transparent images embedded in the Services, emails or ads and may provide information to platforms who may combine your information with other information they have about you. We use pixels to automatically collect information when you visit our Services. These technologies usually track advertising preferences from site to site, and gather data about a user’s browsing habits to improve the user experience. You will not be able to opt-out of any cookies that are “Necessary” for the Site. However, you can choose to accept or decline non-essential cookies and tracking technologies as you wish. If you have accepted such non-essential cookies by opting in, you can change your preferences at anytime by opting out of such non-essential cookies.

Analytics

When you opt in, we use third-party advertising and analytics providers, including platforms such as Google, to help create reports and statistics on the performance of the Site. These platforms may receive information about your interactions with the Services. IMC does not control these third parties’ data collection practices or how the information they collect is used. These platforms operate independently and process information in accordance with their own privacy policies. If you don’t want Google Analytics to be used in your browser, you can install the “Google Analytics Opt-Out Browser Add-On,” provided by Google. When you engage in a transaction with us or click on certain features, we will use a hashing algorithm that protects your Personal Information before we send it to Google for analytics and matching purposes. Third Party Websites and Links

Our Services may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The Services may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.

Security and Data Retention

We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our Services, designed to protect your Personal Information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, and we cannot make any guarantees as to the security or privacy of your Personal Information.

We retain data collected from you only for as long as necessary to complete the purpose for which it was collected or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain Personal Information. At the end of the retention period, Personal Information will be deleted, destroyed, or deidentified.

International Transfers

Our Services are primarily targeted to businesses in the United States, and the Personal Information that we collect is stored on servers hosted by us or our authorized third-party service providers located in the United States and elsewhere. This means that your Personal Information will be collected, processed, and stored in the United States or other countries, which may have data protection laws that are different from (and sometimes less protective than) the laws of your country or region.

By sending us Personal Information, you agree and consent to the processing of your Personal Information in the United States, which may not offer an equivalent level of protection to that required in other countries (particularly the European Union), and to the processing of that information by us on servers located in the United States, as described in this Privacy Policy.

We have implemented safeguards we believe are designed to ensure that the Personal Information we process remains protected in accordance with this Privacy Policy, including when processed internationally or by our third-party service providers. The safeguards we may take in our discretion include, for instance, entering into specific agreements in connection with any onward transfers of Personal Information. Your Privacy Rights

Your California Privacy Rights

As a California resident, you may have certain privacy rights relating to your Personal Information as described below, under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”):

Right to access and data portability. You can request to access your Personal Information that we have collected, used, or otherwise processed in a readable, accessible format. This can include the categories and sources of Personal Information, and the categories of third parties with whom we have shared your Personal Information, if any.

Right to correct inaccuracies. You can request that we correct any inaccurate Personal Information we may have.

Right to delete. You can request deletion of your Personal Information, subject to certain exceptions.

Right to opt-out. You may have the right to opt out of the sale or sharing of your Personal Information if you have previously opted-in.

Right to limit the use of sensitive Personal Information: You may have the right to limit the use of sensitive Personal Information when such use goes beyond that which is necessary for providing the services or certain other permissible purposes. We do not process sensitive Personal Information for purposes other than to provide the Services.

When we receive your request, we will first verify your identity by asking you to provide your name and the email address and phone number reflected in our records. Once we have verified your identity, we will promptly fulfill your request. You may authorize an agent to submit a request on your behalf. We will require (1) the agent to present written permission to do so, signed by you, (2) you to verify your own identity as described above, and (3) you to directly confirm to us that you provided the authorized agent permission to submit the request.

All individuals responsible for handling your inquiry about our business privacy practices and compliance with the CCPA have been informed of all of the requirements of the CCPA, and have been instructed to direct you to exercise your rights under the CCPA. The CCPA prohibits a business from treating a consumer differently because the consumer exercised a right conferred by the CCPA. We welcome you to exercise your rights under the CCPA, and we will not discriminate against you for doing so.

Selling And Sharing Personal Information

We do not sell your Personal Information to third parties for profit. Like most companies that operate online, we use online analytics to measure the ways users engage with our Services and to provide targeted marketing if you opt in. These analytics, in turn, inform how we perform online advertising. In order to provide these analytics for cross-contextual behavioral advertising and facilitate online advertising, we use third parties that collect device identifiers and place tags, pixels, cookies, beacons, and similar tracking mechanisms on our Services as set forth in this Privacy Policy. As we ask for you to opt in to these analytics, California law would not classify this limited sharing with contracted third parties as a “sale” or “share” of Personal Information.

Other States’ Privacy Rights

Depending on your location, residents of certain states may have the right to request:

Right to appeal. At times we may be unable to process requests relating to your Personal Information, in which case, your request will be denied. Other than as set forth in this Privacy Policy, we do not collect or process Personal Information that may be considered “sensitive.” We do not use Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects for a consumer.

The exact scope of these rights may vary by state. To exercise any of these rights, or to appeal a decision regarding a consumer rights request, please contact us at it@imcexperiences.com. Please note that we may need to authenticate your identity before your request can be processed, providing us with 2-3 pieces of Personal Information which we will match to the information we maintain about you. For authentication, you may be asked to provide certain Personal Information that we will match against our records. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

We will not discriminate against you in a manner prohibited by applicable laws because you exercise your privacy rights. We welcome you to exercise any privacy rights applicable to you.

EEA, UK, and Switzerland

Lawful Basis for Processing Personal Information

The legal basis for collecting and using the Personal Information described in this Privacy Policy will depend on the Personal Information concerned and the specific context in which we collect it. However, we will normally collect Personal Information from you only where we have your consent to do so, where we need the Personal Information to perform a contract with you (for example when you purchase our Services), or where the processing is in our legitimate interests and in some cases, we may also have a legal obligation to collect Personal Information from you.
